Effective October 23, 2026.
The service
Day 8 is an iOS productivity app that helps people turn ideas into real projects through personalized AI next moves, progress tracking, and a live leaderboard. These terms are meant to cover the app and this marketing website.
Day 8 is offered by Evan Aquino, based in Georgia, United States.
Apple’s app license
Day 8 is distributed through Apple’s App Store. Downloading it requires an Apple ID and a compatible device.
The license for the downloaded app is Apple’s standard Licensed Application End User License Agreement, unless a valid custom end-user license applies. Day 8 uses Apple’s standard agreement. These website terms supplement that license. They do not override it, and they do not override a consumer protection that applicable law requires.
Next moves
A next move is generated with AI. It can be incomplete or inaccurate, and it is not guaranteed to produce a result. It does not guarantee a project, business, financial, or personal outcome. You decide whether to follow a suggestion.
Day 8 Pro
Day 8 Pro is an auto-renewable subscription sold by Apple inside the iOS app. In the United States, the price is $3.99 per month or $24.99 per year. Elsewhere, the App Store shows the local price. This website cannot sell, renew, cancel, or refund a subscription.
Apple manages billing, cancellation, and refund requests. Payment is charged to the Apple ID when you confirm. The subscription renews automatically unless you cancel it under Apple’s subscription rules, at least 24 hours before the end of the current period. Apple charges the renewal within 24 hours before that period ends. You can manage the subscription, and turn off renewal, in your Apple ID account settings. Canceling stops the next renewal. It does not erase the period you already paid for. Deleting a Day 8 account does not cancel an Apple subscription.
Day 8 Pro adds a leaderboard badge and one builder profile for the account. The profile stays the same when a person switches pursuits. The app does not describe the leaderboard, pursuits, or next moves as Pro-only. Plan details are on the Plans page.
Acceptable use
People should use Day 8 for their own projects. They agree not to:
- Harass, threaten, or abuse another person through a display name, profile, photo, link, or other use of the service.
- Impersonate another person, or present someone else’s project, name, or photo as their own.
- Publish a public name, profile, photo, or link that is unlawful, infringing, or offensive, or use one to spam.
- Manipulate the leaderboard, including by recording work they did not do, creating extra accounts to distort rank, or otherwise interfering with who appears on the board.
- Break, overload, probe, or gain access to the app, the website, or the servers beyond what the product offers, or otherwise interfere with the service.
- Use Day 8 to violate the law.
A person can report a display name from the leaderboard. The app stores that report. A report does not by itself hide the name. Day 8 does not promise a review queue, a response time, or an automated filter.
Subject to applicable law, Evan Aquino may hide a public leaderboard name, unpublish a builder profile or a link on it, or end the leaderboard account when these rules are broken or when keeping the account would interfere with the service. That step does not erase Day 8 from the phone and does not cancel an Apple subscription.
Ideas and projects
You keep ownership of your ideas, pursuits, notes, photos, project descriptions, links, and other project content you put into Day 8. You give Day 8 permission only to provide the features you request: storing that content on your phone, storing and displaying the leaderboard and profile information you choose to publish, and sending the text needed for a feature you request, including a next move, to the server and to OpenAI. This permission is not a transfer of ownership, and it is not a license to use your content in advertising.
That permission ends for content you delete, unpublish, reset from the phone, or remove by deleting the account, except for a copy a provider may still keep under the retention described in the Privacy Policy.
The leaderboard and builder profile
Day 8 includes a live leaderboard. What other people can see, and how to leave the board, is described in the Privacy Policy. A published builder profile can include links to other websites. Day 8 does not operate those websites. To the extent applicable law allows, Day 8 is not responsible for their content or for what they do with a visit.
Intellectual property
Day 8 is offered by Evan Aquino. The Day 8 name is not described here as a registered trademark.
Disclaimers and liability
These terms have not been reviewed by an attorney. The liability limit below is not a guarantee that a court will enforce it.
To the maximum extent permitted by applicable law, Day 8, including its mobile application, website, AI-generated suggestions, leaderboard, and related features, is provided “as is” and “as available.” Evan Aquino disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such warranties cannot lawfully be excluded. Day 8 does not guarantee uninterrupted access, error-free operation, preservation of streaks or data, or any particular personal, professional, or business outcome. Nothing in these terms excludes a consumer right or remedy that cannot legally be excluded.
To the maximum extent permitted by applicable law, Evan Aquino will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost business opportunities, lost data, or lost progress, arising from or relating to Day 8.
To the maximum extent permitted by applicable law, Evan Aquino’s total aggregate liability for claims arising from or relating to Day 8 will not exceed the greater of (a) $100 USD or (b) the amount the claimant paid for Day 8 Pro through Apple during the 12 months immediately preceding the event giving rise to the claim.
These limitations do not apply where prohibited by law and do not exclude liability that cannot lawfully be limited, including liability for fraud, intentional misconduct, or other non-excludable claims.
Ending use
You can reset Day 8 on the phone, leave the leaderboard, or delete the leaderboard account. What each one removes is described in the Privacy Policy and on Support. Deleting the account does not cancel an Apple subscription.
Governing law
These terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise. Nothing in this provision deprives consumers of mandatory protections available under the laws that apply to them.
Changes
When these terms change, the date at the top changes and the new text stays on this page. For a material change, the updated terms are posted here before that change is treated as the current terms. Day 8 does not keep a mailing list, and the current app does not show a separate notice for terms changes, so this page is the notice.
